Introduction
GoJoe is a health, fitness and wellbeing platform providing features, information and resources provided through the GoJoe app (including the browser-based version), the GoJoe Performance Hub, website, blog, emails, social media posts and other products and services (‘the GoJoe Platform’).
References to “GoJoe”, “we”, “us” “its” and “our” should be construed as references to GoJoe App Limited, a company incorporated and registered in England and Wales with company number 11946519, whose registered office is at Level One, Basecamp Liverpool, 49 Jamaica Street, Liverpool L1 0AH.
GoJoe provides you with access to its GoJoe Platform and any other domains, microsites or web pages maintained by or on behalf of it subject to the following terms and conditions (“Terms of Use”), including the Schedules to them, each of which forms part of these Terms of Use.
Please read these Terms of Use carefully before accessing or using the GoJoe Platform. These Terms of Use are an agreement between you and GoJoe App Limited.
Which documents apply to you.
These Terms of Use apply to everyone who uses the GoJoe Platform. In addition: (a) if you have access through your employer or another organisation, the section headed ‘Accounts provided through an organisation’ applies to you; (b) if you can earn or redeem points, Schedule 1 (Rewards Terms) applies; (c) Schedule 2 (Acceptable Use Policy) applies to everything you post, share or do on the GoJoe Platform; (d) Schedule 3 (Connected services) applies if you connect a wearable, app or platform, or if you use our apps from the Apple App Store or Google Play; (e) Schedule 4 (United States) applies if you are resident in the United States, and contains an agreement to arbitrate and a waiver of class actions which affect your legal rights; and (f) any Country Terms we publish for your country apply in addition. Where a Schedule conflicts with the main body of these Terms of Use, the Schedule prevails.
These Terms of Use apply to all users of the GoJoe Platform. You must accept these Terms of Use to create an account and access the GoJoe Platform. By accessing and / or using any part of the GoJoe Platform, you agree to be bound by the following Terms of Use. We ask you to accept these Terms of Use when you create your account, and we keep a record of the version you accepted and when.
The GoJoe Platform does not provide medical advice or services. If you believe that you need medical advice you should contact a doctor or other medical practitioner. If you are having a medical emergency or require urgent medical care, you should call the emergency services immediately.
Changes to the Terms of Use
We may change these Terms of Use from time to time. If a change is material – for example a change to your rights, to our liability to you, to the Rewards Terms, or to how disputes are resolved – we will give you at least 30 days’ notice before it takes effect, by in-app notification or email. Other changes take effect when we post them, and we will always show at the top of this page when the Terms of Use were last updated.
You can review the most current Terms of Use at any time on this webpage. If you do not agree to a change, you can close your account before it takes effect. If you do that and you hold unredeemed Points, Schedule 1 explains what happens to them.
Continuing to use the GoJoe Platform after a change has taken effect means you accept the updated Terms of Use.
Data Privacy
For information about how we deal with your personal data please see our Privacy notice (https://www.gojoe.com/privacy-policy). By accessing or using the GoJoe Platform, you agree that we can collect and use your information in accordance with the Privacy Notice.
Our roles. For some information we are the data controller – this includes your account, the content you create, and the activity, wearable and health information you choose to share with us. For other information we act as a processor on behalf of the organisation that gives you access to GoJoe – this includes eligibility information it provides about you, and messages we send at its instruction. Our Privacy Notice explains which is which. Your organisation’s own privacy notice will also apply to the information it controls.
Health information. Some of what the GoJoe Platform can process is health information – for example data from a wearable, your answers to a health assessment, or screening results your organisation asks us to show you. We process that information only where you have given us your explicit consent, which we ask for separately at the point it arises and which you can withdraw at any time. Your individual health information is visible to you. It is not shown to other users, and it is not shared with your employer or sponsoring organisation. There are two exceptions, and we tell you about them when they apply: where your organisation runs an incentive programme, we tell it whether or not you have completed a qualifying activity; and where rewards are taxable, we report the value of the rewards you redeem. In neither case do we share the health information behind them. Any other reporting we provide to your organisation is aggregated and does not identify you.
Your privacy rights. You can exercise your data protection rights as set out in the Privacy Notice. Where we hold information as a processor for your organisation, we may need to pass your request to it, and we will tell you when we do.
Eligibility and your account
You must be at least 18 years old to use the GoJoe Platform. Where the organisation that provides your access asks us to enable it and we agree in writing, we may permit access from age 16, and we will tell you before you create your account if that applies. The GoJoe Platform is not intended for and must not be used by anyone under 16, and we do not knowingly collect information from anyone under 16. If you believe someone under 16 has an account, please contact us at privacy@gojoe.com.
You are responsible for your GoJoe account and for all activity that occurs in association with your GoJoe account. You must give us accurate information when you register, keep it up to date, and not let anyone else use your account. You are responsible for keeping your account access details confidential. We are not responsible for losses caused by your failure to do so, except to the extent those losses are caused by us.
Full use of the GoJoe Platform is dependent upon your use of a computer with adequate software or a supported mobile device and internet access. It is your responsibility to ensure the equipment’s functionality. You are responsible for all internet access charges. Please check with your internet provider for information on possible internet data usage charges.
Accounts provided through an organisation
Most people use the GoJoe Platform because their employer, insurer or another organisation has bought it for them (your “Organisation”). If that is how you have access, this section applies to you, and prevails over anything inconsistent elsewhere in the main body of these Terms of Use.
Your Organisation decides who is eligible, which features and programmes are switched on, which challenges run, whether rewards are funded and at what level, and how long access lasts. We act on its instructions in those respects. We are not responsible for those decisions. Questions about them – including eligibility, benefit entitlement, and any incentive, credit or contribution your Organisation offers – should go to your Organisation, not to us.
Your Organisation may give us information about you so that we can set up and manage your access, and may ask us to send you messages about its programme. You cannot opt out of those programme messages while you have an account, although you can manage your notification settings as described in the Privacy Notice.
Your access ends when your Organisation’s contract with us ends, when you stop being eligible, or when your Organisation asks us to close your account. We will give you notice where we reasonably can. Schedule 1 explains what happens to any Points you hold.
Where an incentive, credit, contribution or other benefit is provided by your Organisation or by a benefit plan, the terms of that plan or programme govern it – not these Terms of Use. Nothing in these Terms of Use varies any benefit plan or any contract of employment, and nothing in them creates any employment right or entitlement.
Connected accounts
Your Organisation may allow certain people connected to you – for example a spouse or partner, or in some programmes other family members – to have their own account (a “Connected Account”). Connected Accounts are for adults only and are subject to the same age rules as any other account.
A Connected Account belongs to the person who holds it. They must accept these Terms of Use in their own name. You cannot see their activity, content or health information and they cannot see yours, except where you are both taking part in the same challenge, team or group in the ordinary way. Each of you can exercise your privacy rights independently of the other.
If your Organisation reports the value of redeemed rewards for tax purposes, redemptions made on a Connected Account linked to you may be reported against you. Schedule 1 explains this.
If the connection ends – for example because eligibility changes, or because your own access ends – we will tell the Connected Account holder and give them a reasonable period to redeem any Points before their access ends.
Duration of access to the GoJoe Platform
Your employer or organisation may purchase a premium version of the GoJoe Platform for you for a set duration (the “Term”). The benefits of premium membership are as set out on the GoJoe Platform and in the Rewards Terms at Schedule 1.
The terms that apply to points and rewards are set out in Schedule 1 (Rewards Terms), which forms part of these Terms of Use.
Your Content on the GoJoe Platform
The GoJoe Platform may enable you to post, upload, store, share, send, or display User Generated Content (UGC) including text, photos, images, videos, data and / or other content including messages and suggestions. By making your UGC available through the GoJoe Platform, excluding any private messages, you hereby acknowledge that such UGC may be visible to other users of the Platform (subject to your privacy settings within the Platform).
Where submitting UGC within a Challenge or Organisation-wide chat group – for example as part of a photo-competition – you acknowledge that such UGC may be reproduced by your employer for the strict purposes of announcing entries into, and/or the winner of, said photo competition for internal purposes only.
Licence you give us. So that we can operate the GoJoe Platform, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, cache, back up, reformat, transcode, translate, moderate and display your UGC, and to sub-licence those rights to the hosting, storage and content delivery providers we use to run the service. That licence is limited to operating the GoJoe Platform and making your UGC available to you and to the other users entitled to see it. It lasts while your UGC is on the GoJoe Platform, and for a short period afterwards while it works its way out of our backups.
For the avoidance of doubt, GoJoe shall not utilise, reproduce or modify any such UGC (other than the hosting and displaying of such UGC within the Platform in the ordinary course of its operation) and other than as set out in the licence above, without the prior explicit consent of the User. In particular, we will not use your UGC in marketing or promotional material, or for any purpose unconnected with operating the GoJoe Platform, without asking you first.
If you do not wish to grant GoJoe the rights set out above, do not submit contributions to the GoJoe Platform.
You are responsible for any UGC. GoJoe reserves the right to remove content from the GoJoe Platform where we reasonably suspect such content uploaded as UGC is inappropriate.
Rules for content and conduct. What you may and may not post, share or do on the GoJoe Platform is set out in Schedule 2 (Acceptable Use Policy), which forms part of these Terms of Use. Schedule 2 also explains how to report content or behaviour, what we do when we receive a report, and how to challenge a decision we make about your content or your account.
GoJoe may, but without the obligation to do so, monitor UGC and other communications transmitted via the GoJoe Platform and remove any unlawful or inappropriate content.
GoJoe may at its sole discretion remove, or refuse to display UGC and may prevent you from posting, uploading, storing, sharing, sending, or displaying UGC to and via the GoJoe Platform. Where we do, we will tell you what we have done and why, and you can ask us to review the decision, as set out in Schedule 2.
Chat groups
The GoJoe Platform may contain commenting features, message boards, bulletin boards, chat groups or other forums in which users are able to post UGC for viewing by others. We do not review everything users post before it appears. We do operate moderation and integrity tools, and we act on reports. If you become aware that any UGC on those pages or any activities carried out on those pages, which are offensive, unlawful or infringe any third-party rights in any way, please report it using the reporting tools in the GoJoe Platform, or email us at help@gojoe.com. Schedule 2 explains what happens next.
Copyright and intellectual property
All information, data, text, documents, graphics, logos, designs, images, pictures, photographs, videos, podcasts, weblogs, software, interactive features or any other content, services or materials (and any part of them) (the "Materials") accessible on the GoJoe Platform are protected by copyright, trademarks and other intellectual property rights and are the proprietary materials of GoJoe and/or third parties associated with it and we reserve all rights that are not specifically granted under these Terms of Use.
Except where it is otherwise indicated as acceptable on the GoJoe Platform, you may not reproduce, modify, adapt, post, transmit, copy, make available or distribute or otherwise use any of the Materials on the GoJoe Platform without the prior written permission from either GoJoe or the owner of the relevant intellectual property rights. Any use made of such Materials may be an infringement of rights in those Materials and GoJoe reserves all rights to enforce such rights.
You may read, view, print and (where permitted) listen to and download the contents of an individual page for private and personal non-commercial use only, provided that all copyright, trademark and other proprietary notices contained in the Materials on any copy of these Materials is retained. You may not recopy or further distribute, sell, publish or transmit any part of the Material by electronic or any other means.
You agree not to sell, resell, supply or otherwise make the content contained on the GoJoe Platform or extracts or other information derived therefrom available in any manner or on any media to any third party without the prior written consent of GoJoe.
Requests for written approval should be emailed to info@gojoe.com. Please give details of your intended use of the material and include your contact details: - your name, address, telephone number and email.
Third Party Links
We restrict links made from the GoJoe Platform to other sites to certain associated and supporting organisations. Links to us and from us are provided at our absolute discretion and may be altered, or removed from the GoJoe Platform, by us at any time. Third party links may direct you to third-party websites that are not affiliated with us. GoJoe is not responsible for the contents or reliability of any site to which it is linked and does not necessarily endorse the views expressed within them. Linking to or from this App should not be taken as an endorsement of any kind. We cannot guarantee that links will work all of the time and we have no control over the availability of the linked pages. We accept no responsibility for any consequences relating directly or indirectly to any action or inaction you take based on such information.
Connected services and health information from third parties
You can connect a wearable device, app or platform to the GoJoe Platform. If you do, Schedule 3 (Connected services) applies, and so do the terms of the provider you are connecting. We receive only the data types shown to you when you connect, we ask for your explicit consent at that point, and you can disconnect at any time in your settings or in the provider’s own app.
Where your Organisation has enabled it, the GoJoe Platform may show you health information we receive from a third party – for example results from a health screening provider. We display that information as we receive it. We do not check it, interpret it or diagnose from it, and it is not medical advice. If you think a result is wrong, contact the provider that produced it or your Organisation; we cannot amend their records. Tell us as well and we will pass the request on.
Disclaimer
Any information or other materials, including financial wellbeing information provided via GoJoe Platforms are intended for general information purposes only. The GoJoe Platform is provided “as-is” and without warranty, guarantee or representation of any kind.
GoJoe is not responsible or liable for any information, services, products or content that is obtained via the GoJoe Platform. Further GoJoe is not liable for any direct or indirect losses, fines, compensation, costs, proceedings, deficiencies or damages suffered or incurred as a result of the GoJoe Platform. This paragraph is subject to the section headed Limitation of liability below, and in particular to the liability we do not exclude.
Any output does not substitute professional medical advice, a diagnosis or a treatment plan or professional financial or well-being advice. Any information found on the GoJoe Platform is not intended to be relied upon and is not a substitute for professional medical or professional financial advice based on your individual condition and circumstances.
Content found in GoJoe Platform, including any content which has been commissioned in good faith, from third parties is for informational and educational purposes only and is not intended to replace the relationship between you and your doctors, other medical providers including nutritionists, financial advisors or other professionals.
As such we do not accept any responsibility for any health, well-being or financial problems that may result from any content on the GoJoe Platform. This is subject to the section headed Limitation of liability below.
If you engage in any physical activity or sports received or learned about through GoJoe Platform, it is at your own risk, and you are voluntarily participating in these activities. You should always take steps to ensure that you are well and capable of taking part in any physical activities or sports found in GoJoe Platform. You should always consult your doctor or medical professional before taking part in any physical activities or sports and when starting a fitness programme or changing your diet, particularly if you have a medical condition or you are not usually physically active.
You should:
You are responsible for monitoring your own condition during all physical activity or sports. If you suffer any unusual symptoms, you must stop the activity and seek professional medical advice.
We do not warrant that the operation of the GoJoe Platform will be uninterrupted or error free, that defects will be corrected, or that the GoJoe Platform and any other GoJoe products and services or the server that makes it available are free of viruses or represent the full functionality, accuracy, and reliability of the GoJoe Platform.
Your access to the GoJoe Platform may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.
Indemnification
You agree to indemnify and hold harmless GoJoe, its officers, directors, employees, affiliates, agents, licensors and contractors from and against any losses, liabilities, costs or expenses arising out of or in connection with: (a) your breach of these Terms of Use or of any applicable law; or (b) your misuse of the GoJoe Platform, including any UGC you submit that infringes the rights of a third party or otherwise causes loss to GoJoe. This indemnity applies only to the extent such losses are caused by your acts or omissions and shall not apply to the extent any loss arises from GoJoe’s own acts, omissions or negligence. This indemnity is limited to claims made against us by third parties, and does not apply where you are acting as a consumer and the law of the country in which you are habitually resident does not permit it.
Limitation of liability
Nothing in these Terms of Use limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982; or any other liability which cannot lawfully be limited or excluded. If you are a consumer, you have legal rights which these Terms of Use do not affect.
Subject to the paragraph above, we are not liable to you for: loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; loss of, corruption of, or loss of use of, data; or any indirect or consequential loss.
Subject to the first paragraph of this section, our total liability to you arising out of or in connection with these Terms of Use and your use of the GoJoe Platform, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the greater of (a) the total amount you have paid us in the twelve months before the event giving rise to the liability and (b) £100.
Who these exclusions and limits protect. This section applies for our benefit and also for the benefit of our group companies, and our and their directors, officers, employees, agents, subcontractors, suppliers, licensors and content partners. Each of them may rely on and enforce this section under the Contracts (Rights of Third Parties) Act 1999. You and we may vary or terminate these Terms of Use without their consent.
We are not liable for physical damage, or for loss of profit, business, business interruption or business opportunity, arising in connection with rewards provided by a rewards fulfilment partner, including any delay, error, suspension or withdrawal. Schedule 1 contains further terms about rewards.
You decide whether you are fit to take part in any physical activity, and you are responsible for stopping if you feel unwell. We do not supervise, prescribe or monitor your activity.
Advertising and sponsorship
The GoJoe Platform may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that any content submitted for inclusion on the GoJoe Platform complies with relevant laws and codes. GoJoe will not be responsible for any error or inaccuracy in advertising and sponsorship content.
Competitions and prizes
From time-to-time GoJoe may run or host competitions, free prize draws and promotions on the GoJoe Platform. Additional terms and conditions may apply to surveys, contests, giveaways, and other promotions sponsored by GoJoe or its partners. It is your responsibility to carefully review those terms and conditions. We will publish the rules for each promotion before you enter. Those rules will say who can enter, which countries the promotion is open in, how entries are earned, how winners are chosen and what the prize is. Promotions are void where prohibited by law.
Governing law and disputes
These Terms of Use shall be governed by, and interpreted in accordance with, the laws of England and Wales.
If you are a consumer, this does not deprive you of the protection of any mandatory rules of law of the country in which you are habitually resident, and you may bring proceedings in the courts of that country. Otherwise, the courts of England and Wales have exclusive jurisdiction over any dispute, claim or matter arising under or in connection with these Terms of Use.
If you are resident in the United States, Schedule 4 applies to disputes instead of this section. Schedule 4 contains an agreement to resolve disputes by individual arbitration and a waiver of class actions and jury trial. Please read it. You can opt out of it within 30 days of accepting these Terms of Use.
Suspension and termination
You can close your account at any time in the app, or by contacting us at info@gojoe.com.
We may suspend or close your account, or restrict your access to parts of the GoJoe Platform, if you breach these Terms of Use or Schedule 2, if we are required to by law, or if your Organisation asks us to or its contract with us ends. We will give you notice and, where the reason is something you can put right, a reasonable opportunity to do so – except where we need to act immediately to protect other users, to protect the security of the service, or to comply with the law.
Before we close your account we will give you a reasonable opportunity to download your content, unless we are prevented from doing so. We may retain information after your account closes where the law requires it, or where we are required to by an agreement with your Organisation or a benefit plan. The Privacy Notice explains for how long.
The following sections survive termination: Data Privacy; Your Content on the GoJoe Platform, in respect of content already posted; Copyright and intellectual property; Disclaimer; Indemnification; Limitation of liability; Governing law and disputes; and General. In the Schedules, the provisions of Schedule 1 on expiry and forfeiture of Points, and the dispute resolution provisions of Schedule 4, also survive.
General
Order of precedence. If there is any conflict between the main body of these Terms of Use and a Schedule, the Schedule prevails. If there is any conflict between these Terms of Use and the Privacy Notice on a data protection matter, the Privacy Notice prevails.
Entire agreement. These Terms of Use, together with their Schedules, the Privacy Notice, and any promotion rules or Country Terms we publish, are the entire agreement between you and us about your use of the GoJoe Platform. Nothing in this paragraph limits or excludes liability for fraud or fraudulent misrepresentation.
Severance. If any provision of these Terms of Use is found to be invalid by a court of competent jurisdiction, that does not affect the validity of the remaining provisions, which remain in full force and effect.
Waiver. A failure or delay by either of us in exercising any right or remedy is not a waiver of it, or of any other right or remedy.
Events outside our control. Neither of us is responsible for any failure or delay in performing our obligations caused by events outside our reasonable control. If such an event occurs we will let you know and take reasonable steps to minimise its effect.
Transfer. We may transfer our rights and obligations under these Terms of Use to another organisation. We will tell you if we do, and it will not affect your rights. You may not transfer your rights or obligations, or your account, to anyone else.
Notices. We will contact you using the email address or in-app messaging associated with your account. You can contact us at info@gojoe.com, or at the address given at the top of these Terms of Use.
Third party rights. Except as set out in the Limitation of liability section, and in Schedule 3 in relation to the app stores, these Terms of Use do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999.
Complaints. If you are unhappy with the GoJoe Platform, or with how we have handled something, contact us at info@gojoe.com and we will try to resolve it with you.
Headings. The section headings in these Terms of Use are for convenience only and have no legal effect.

(a) I have no medical condition, which I am aware of, that would prevent me from taking part in any physical activities or sports whilst using the GoJoe Platform and I confirm that I have never experienced:
I also confirm that I do not suffer with high blood pressure, a heart condition or diabetes, and I confirm that I am not on any medication prescribed for blood pressure or a heart condition.
(b) I have experienced one or more of the conditions listed in (a) above and I can confirm that I have taken advice from a medical practitioner or doctor who has given me consent to take part in all physical activities, sports or practices in the GoJoe Platform.
(c) I have experienced one or more of the conditions listed in (a) above and I can confirm that I will take advice from a medical practitioner or doctor before I engage in any of the physical activities, sports or practices contained in the GoJoe Platform.
In all circumstances, I acknowledge that if at any time I feel unwell, experience pain or discomfort, I should stop the activity and should seek professional medical assistance.
Schedule 1 – Rewards Terms
1. These Rewards Terms apply where you can earn or redeem points on the GoJoe Platform. They form part of the Terms of Use and, where they conflict with the main body of the Terms of Use, they prevail.
2. Earning Points. You may earn reward points (“Points”) through activity, participation or programmes, or through recognition allocated by your Organisation. Points accrue in your rewards balance (“Rewards Balance”). Points are earned only where the applicable activity, participation or recognition criteria are met; they are not awarded automatically. Points have no cash value, are not your property, cannot be transferred or exchanged, and do not represent wages, compensation, salary, benefits or consideration for any employment.
3. Redeeming Points. Once you have enough Points, you may redeem them for non-cash rewards (“Rewards”), which may include digital vouchers, gift cards or other items made available through the GoJoe Platform (“Physical Rewards”). Physical Rewards are fulfilled by our authorised rewards partners, and availability varies by territory. We make no representation or warranty as to the availability of any particular Physical Reward, which may change or be withdrawn at any time by us or by the partner. Unless we say otherwise, Physical Rewards are non-refundable and may be subject to territorial, regulatory or brand restrictions. You must use Physical Rewards in accordance with any terms we or the partner notify to you, and you must not sell, transfer, exchange or supply them to anyone else.
4. Funding. Where your Organisation funds rewards, the cost is met by your Organisation, not by GoJoe. Your Organisation may fund its programme either by placing funds with us in advance, or by being billed in arrears for the rewards its people actually redeem. Either way we administer the rewards programme on your Organisation’s behalf, and we do not guarantee the availability, value or continuation of the funding behind it. Your Organisation may set different incentive levels or tiers which cap the reward value available in a period; a tier is a cap on availability and is not a guarantee that you will earn or redeem the full amount. Your Organisation may also allocate discretionary recognition rewards entirely at its own discretion. If your Organisation does not provide the funding it has agreed, we may suspend redemptions on its programme and we are not obliged to fulfil rewards.
5. Expiry. Points expire six months after the end of the month in which they are earned, unless we state otherwise in the GoJoe Platform or unless your Organisation has configured the GoJoe Platform to operate in a different way. We will always show, in the app, the expiry period that applies to your programme and the date your Points are due to expire. If your Organisation changes that period, the change applies only to Points you earn after it takes effect. Expired Points cannot be reinstated or redeemed. We will remind you in the app before Points expire.
6. If your access ends. You can only redeem Points while you have an active premium account. If your Organisation’s contract with us ends or is not renewed, or your premium access otherwise ends or lapses, any unredeemed Points will be forfeited and cannot be carried forward or transferred. Where we reasonably can, we will tell you in advance and give you a period in which to redeem. Unclaimed Points are not a debt owed to you by us or by your Organisation.
7. Pausing redemptions. If redemptions on your Organisation’s programme reach 95% of the reward budget available for the relevant period – whether that budget has been funded in advance or agreed with your Organisation for billing in arrears – we may pause redemptions on that programme until your Organisation adds funds, upgrades its reward tier, or accepts the pause. We will tell you if this happens and why. A pause does not cause Points you have already earned to expire while it is in force; the expiry date of any Points affected is extended by the length of the pause.
8. Tax. Rewards may be taxable, and how they are taxed depends on where you live and on your Organisation’s arrangements. Where your Organisation operates payroll reporting for rewards, we report the value of the rewards you redeem to your Organisation and to its payroll provider so that any tax can be handled correctly. That report covers the value and fact of your rewards; it does not include your health information or the detail of the activity that earned your Points. If a Connected Account is linked to you, redemptions on that account may be reported against you. We do not give tax advice.
9. Paid purchases. If you buy anything from us directly you have a legal right to cancel within 14 days of purchase, unless you ask us to start providing it immediately and acknowledge that you will lose that right once we have. This does not affect your other legal rights as a consumer.
10. Integrity. Points awarded in error, or as a result of activity that breaches Schedule 2 – including manipulated, spoofed or duplicated activity data – may be adjusted or removed. We will tell you if we do this and why, and you can ask us to review it.
11. Liability. In addition to the Limitation of liability section of the Terms of Use, and so far as the law allows, we are not liable for physical damage, or for loss of profit, business, business interruption or business opportunity, arising in connection with Physical Rewards provided by a rewards partner, including any delay, error, suspension or withdrawal. Schedule 2 – Acceptable Use Policy
1. This Acceptable Use Policy applies to everything you post, upload, store, share, send or display on the GoJoe Platform (“UGC”) and to how you behave on it. It forms part of the Terms of Use.
2. Do not post content that is obscene, indecent, pornographic, seditious, offensive, defamatory, threatening, menacing, blasphemous, that is liable to incite racial hatred or acts of terrorism, or that breaches anyone else’s intellectual property or other rights.
3. Do not post content that is fraudulent, false, misleading or deceptive, and do not promote illegal or harmful activities or substances.
4. Do not upload anything containing software viruses, or designed to interrupt, destroy or limit the functioning of the GoJoe Platform or any equipment or service, or any other harmful, disruptive or destructive file or content.
5. Do not use anyone else’s account without authorisation, impersonate any person or entity, or attempt to gain unauthorised access to the GoJoe Platform, or do anything that could damage, disable, overburden or impair it.
6. Do not harvest, solicit or collect information about other users, and do not make available personal data about anyone other than yourself. Do not send unsolicited communications, advertising, promotional material, junk mail, spam, chain letters or pyramid schemes, and do not advertise or promote products or services commercially.
7. Do not remove any copyright or trademark notice from content, and do not use the GoJoe Platform in any way that might bring GoJoe into disrepute.
8. Do not upload a photograph or video that shows another identifiable person unless you have their consent.
9. Activity integrity. Record your activity honestly. Do not falsify, manipulate, duplicate or artificially generate activity data, do not spoof location or device data, do not use a device or vehicle to generate activity you did not perform, and do not share an account or a device in order to accumulate Points. We use automated and manual checks to detect this. If we investigate your activity we will handle any evidence privately and will not post it to any feed or group.
10. Reporting. If you see content or behaviour that breaks these rules, report it using the reporting tools in the GoJoe Platform, or email help@gojoe.com. We will look at every report, act where the rules have been broken, and tell you the outcome.
11. What we may do. If you break these rules we may remove or restrict access to the content, limit or suspend features, adjust or remove Points, or suspend or close your account. We will choose a response proportionate to what has happened.
12. Telling you, and challenging a decision. If we remove your content or restrict your account we will tell you what we have done, why, and what rule applies, unless the law prevents us. If you think we have got it wrong you can ask us to review the decision by replying to that message or emailing help@gojoe.com, and a person who was not involved in the original decision will look at it again.
Schedule 3 – Connected services, wearables and app stores
1. Connecting a service. You can connect a wearable device, app or platform to the GoJoe Platform. When you do, we show you the data types we will receive and ask for your consent. We receive only those data types. You can disconnect at any time, in your GoJoe settings or in the provider’s own app or device settings; disconnecting stops further data coming to us from that source but does not delete data we have already received, which you can ask us to delete as described in the Privacy Notice (https://www.gojoe.com/privacy-policy).
2. The provider’s terms. The device, app or platform you connect is operated by someone else, under their own terms and privacy policy. We are not responsible for their products, for the accuracy of the data they send us, or for their availability. If they change or withdraw their service, features of the GoJoe Platform that depend on it may stop working.
3. Health data from connected services. We do not use data received from a connected service for advertising, we do not sell it, and we do not disclose it to third parties for their own purposes. Your individual data from a connected service is visible to you and is not shared with your employer or sponsoring organisation.
4. Apps obtained from an app store. If you obtained the GoJoe app from the Apple App Store or Google Play, these Terms of Use are between you and GoJoe, not between you and the app store. GoJoe, not the app store, is responsible for the app and its content. The app store has no obligation to provide maintenance or support. Apple and its subsidiaries are third party beneficiaries of these Terms of Use and Apple has the right to enforce them against you. You may use the app only on a device you own or control and as permitted by the app store’s usage rules.
5. You confirm that you are not located in a country subject to a comprehensive government embargo, and that you are not on any government list of prohibited or restricted parties.
Schedule 4 – Additional terms for users in the United States
This Schedule applies if you are resident in the United States and, where it conflicts with the main body of the Terms of Use, it prevails.
1. PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT, TO HAVE A JURY DECIDE YOUR CASE, AND TO PARTICIPATE IN A CLASS ACTION.
2. Informal resolution first. Before starting arbitration, you agree to contact us at info@gojoe.com and give us 60 days to try to resolve the dispute with you. We agree to do the same before starting proceedings against you.
3. Agreement to arbitrate. If we cannot resolve a dispute informally, you and GoJoe agree that any dispute arising out of or relating to these Terms of Use or the GoJoe Platform will be resolved by binding individual arbitration, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, rather than in court. If the AAA is unavailable or declines to administer the arbitration, you and we will agree another established arbitration provider, or a court may appoint one under section 5 of the Federal Arbitration Act. The arbitration may be conducted on documents only, by telephone or video, or in person in the county where you live, as you choose. The arbitrator, and not any court, decides all questions about the interpretation and scope of this agreement to arbitrate, except that a court decides whether a dispute may proceed as a class or representative action.
4. Class action and jury trial waiver. You and GoJoe each waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, consolidated or representative proceeding. The arbitrator may not consolidate more than one person’s claims. If this paragraph is found unenforceable in respect of a particular claim, that claim, and only that claim, will proceed in court.
5. Batching. Where 25 or more similar claims are asserted against us by or with the assistance of the same law firm or coordinated group, you and we agree that those claims will be resolved in staged batches of no more than 50, in the interests of resolving them efficiently, with limitation periods tolled for claims awaiting their batch.
6. Your right to opt out. You can opt out of paragraphs 3, 4 and 5 by emailing info@gojoe.com with your name, the email address on your account and a statement that you are opting out of arbitration, within 30 days of first accepting these Terms of Use. Opting out will not affect your access to the GoJoe Platform or any other part of your relationship with us. If you opt out, any dispute between us will be heard by the federal or state courts located where you live in the United States, and you and we each consent to the jurisdiction of those courts.
7. Small claims. Either of us may bring an individual claim in a small claims court instead of arbitration, if it qualifies.
8. Health plan and HIPAA. Where the GoJoe Platform is provided to you through an employer-sponsored group health plan, some of the information we hold may be protected health information which we handle as a business associate of that plan, under a business associate agreement and the plan’s notice of privacy practices. Requests to see or correct that information may need to go to the plan, and we will tell you where to direct them. Nothing in these Terms of Use varies the terms of any benefit plan; eligibility for and payment of any incentive, credit or premium contribution is determined under the plan documents, and disputes about the benefit itself follow the plan’s claims and appeals procedures.
9. Consumer health data. Some of the information we process about you is consumer health data under the laws of certain states. Our Consumer Health Data Privacy Notice explains what we collect, how we use it, who we share it with and how to exercise your rights, including your right to withdraw consent and to ask us to delete it. We do not sell consumer health data.
Schedule 5 – Country Terms
Where we publish Country Terms for the country in which you are habitually resident, those terms apply in addition to the Terms of Use and, where they conflict, they prevail.
United Kingdom and European Economic Area. Nothing in the Terms of Use affects your statutory rights as a consumer, or any mandatory protection available to you under the law of the country in which you are habitually resident. Where we rely on your consent to process health information, you may withdraw it at any time without affecting your access to the rest of the GoJoe Platform.
