GoJoe is committed to keeping your personal data secure.

This privacy notice tells you what to expect when we collect personal information from you. It also explains how we will store, handle and keep your personal information safe.  

This privacy notice (together with our Terms and Conditions as set out at https://www.gojoe.com/terms-and-conditions) and any additional terms of use, together our Terms of Use) applies to your use of:

  • Our GoJoe App mobile application service, once you have downloaded a copy of the GoJoe App onto your mobile telephone or handheld device (device); and
  • Any of the services accessible through the GoJoe App, the GoJoe Business Manager or our website that are available on the GoJoe App Site or any other sites of ours. This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

Please read the following carefully to understand our practices regarding your personal data and how we will treat it.

GoJoe is the controller for the personal information we process unless otherwise stated and is responsible for your personal data, collectively referred to “we”, “us,” “our” or “GoJoe”.  “Users” refer to an individual who uses the App or Website

Compliance with Data Protection Legislation

GoJoe provides:

  • workplace challenges and community features to corporate entities and their employees and / or to Users; and
  • access to our GoJoe community challenges; and
  • health and fitness content and features; and
  • the GoJoe App, GoJoe Business Manager and website;

for the purposes of social fitness and wellness engagement.

All your personal Information will be held and used in accordance with the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018 and any other legislation relating to the protection of personal data (data protection laws).

GoJoe will keep this privacy notice up to date.

Any changes to this privacy notice will be posted on this page and, where appropriate, notified to you when you next start the GoJoe App or log onto the website. The new policy may be displayed on-screen and you may be required to read and accept the changes to continue your use of the GoJoe App or our website.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during our relationship with you.

Information we collect

When you take part in GoJoe Challenges, use our services, GoJoe App, the GoJoe Business Manager, and / or our website we collect the following:

Account information

Some personal information is required to set up the GoJoe App and GoJoe Business Manager including your name and an email address. You may also choose to provide other information including additional contact details, a date of birth, your gender, a profile picture, height, weight, activity levels, posts, media such as photos/videos, workout and activity data, your workplace or organization or other content that can be uploaded by you to our App. Users may elect to alter privacy settings from within the app, which affects the extent to which people can see a user's activities, content and stats.

Users must ensure that, where content is uploaded which depicts or portrays another identifiable individual, consent must have been obtained by said person(s) prior to uploading.

Users acknowledge that, to the extent any content (e.g. photos or videos) is optionally uploaded to the App, this may be seen by other users of the App. Users undertake not to post any harmful, defamatory or malicious content to the App, and acknowledge that breach of such undertaking may result in the suspension or removal of their account without notice.

If you have signed up via your workplace, we will also need to collect some limited employment details for your subscription.

Additional information

Acknowledging that the sole purpose of the GoJoe App is to aid and motivate users to exercise more, you may also upload to the GoJoe App workout and activity data which can be synced from a wearable or the GoJoe tracker, or otherwise added manually. This may include personal information, including distance, location, speed, heart rate and other exercise-related data which is either obtained from third party software providers, via the GoJoe tracker or added manually by you.  You will be asked for specific consent before this data is shared to the GoJoe App from any third-party source or wearable, which will enable you to either consent or refuse your consent to such data collection/ processing.  The workout and activity data will be displayed on feeds within the GoJoe App and as part of GoJoe Challenges including leaderboards.

If you contact us or participate in a survey, contest, or promotion, we collect the information you submit such as your name, contact information, and message.

We also collect, use and share aggregated data such as statistical or demographic data and may use it for any purpose. Aggregated data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your activity within the GoJoe App, the GoJoe Business Manger or in a GoJoe Challenge to calculate the percentage of users accessing a specific App feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

Health and other special categories of personal information

To the extent that information we collect is health data or another type of special category personal data, we ask for your explicit consent to process this data. We obtain this consent separately when you take actions leading to our obtaining that data, for example, when you manually input the data or grant us access to your exercise or activity data from another third-party source or wearable.  We do not share, disclose or otherwise use any personal data, whether health or otherwise, with any third party and it is used solely for the purposes of facilitating your usage of the GoJoe App.

Children’s personal information

We appreciate the importance of taking additional measures to protect children’s privacy.

If you are under 16, you must first tell your parent or legal guardian that you wish to register on our digital platforms and get their consent.

You must make sure that your parent or legal guardian knows and agrees each time before you:  

• email us, or ask us to email anything to you;  

• send any information to us;  

• enter any competition or game that requires information about you or offers a prize;  

• purchase an annual license or one-off Challenge; or  

• offer or agree to buy anything online.

Persons under the age of 16, are not permitted to create accounts unless their parent has consented in accordance with applicable law. If we learn that we have collected the personal information of a child under the relevant minimum age without parental consent, we will take steps to delete the information as soon as possible. Parents who believe that their child has submitted personal information to us and would like to have it deleted may contact us at info@gojoe.com.


Payment Card information


We may process your personal information to process any orders that you make by using our websites, and / or GoJoe App. The information may include information for identification and verification, such as your name, credit, debit or other card number, card expiration date, and CVV code.

Information we receive from the use of our GoJoe App and services.

When your device syncs with the GoJoe App or our software, data may be transferred from your device. This information is used to improve your experience and enable you participate in the GoJoe App and features including GoJoe Challenges. We may also process information such as your browser type, settings and information about how and when you used our service, information about the type of device and/or operating system you are using, which videos you have watched, what content you like or share and which adverts you saw and responded to.

Information received from third parties:  

We may have partnered with third parties, for example your employer, to facilitate a workplace challenge or to otherwise benefit from the GoJoe App and GoJoe Business Manager. In these circumstances your company may have provided us with personal information including your name and email address or similar information, so that we can invite you to participate in a workplace challenge and/or to join your organization within the GoJoe App. We may contact you by email and/or within the GoJoe App to provide you with information about your organization, GoJoe Challenges and features including with information about the activities, leaderboards and outcomes. GoJoe will not disclose any other personal information in such communications.

You may also link your social media accounts to our services which allows us to obtain information from those accounts. All this information will be removed upon your account being deleted.  

How we use your Information:

We will only use your personal data when the law allows us to do so. The law on data protection sets out a number of different reasons for which a company may collect and process your personal data.

When collecting your personal data, we will always make it clear to you which data is necessary in connection with the particular activity.

Most commonly we will use your personal data in the following circumstances:

  • Where you have consented before the processing.
  • Where we need to perform a contract, we are about to enter or have entered with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal or regulatory obligation.

Whenever you have given us your consent to use your personal data, you have the right to change your mind at any time and withdraw that consent. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.

If you have given your consent to receive marketing emails you can withdraw this at any time, or if we are relying on our legitimate interests to send you marketing you can object. In either case, just let us know. If you have received a direct marketing email from us and no longer wish to do so, the easiest way to let us know is to click on any unsubscribe link at the bottom of our marketing emails or to reply to the email with the word “unsubscribe”.

In certain circumstances, we need your personal data to comply with our contractual obligations or to pursue our legitimate interests in a way which might be reasonably expected as part of our running our business. For example, in order to deliver the services to you, we need to use the information you provide us to enable your participation in the GoJoe Challenges or your organization community. We may also use your information to help you find and connect with a workplace challenge and achieve a heathier lifestyle.

We also use your information when we need to contact you about GoJoe including a GoJoe Challenge, about your GoJoe organization or in order to respond to you if you contact us.

Retention:

We will only retain your Information for as long as is necessary for the purpose or purposes for which we have collected it.

Details of retention periods for different aspects of your personal data are available in our retention policy which you can request by contacting us.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for analytical or statistical purposes, in which case we may use this information indefinitely without further notice to you.

In the event you do not use the GoJoe App for 24 months your personal information will be deleted by us unless you confirm to us that you would like us to keep your data on file.  If, in the meantime, you wish for us to delete or amend your information before the 24 month period has expired, then you can do so at any time by emailing info@gojoe.com.

How and why you information is shared:

We sometimes share your personal data with trusted third parties. We will never sell the personal information of our users.

The reasons we may share your data with third parties are:  

(a) if we are under a legal or regulatory duty to do so,

(b) if it is necessary to do so to enforce our terms of use, terms and conditions or other contractual rights,

(c) to lawfully assist the police or security services with the prevention and detection of crime or terrorist activity,

(d) where such disclosure is necessary to protect the safety or security of any persons, and/or

(e) otherwise as permitted under applicable law.

We may also share your personal information to help us provide our services, including the GoJoe App, the GoJoe Business Manager and the GoJoe website. We have contracts with companies who provide us with services such as infrastructure and hosting providers, technology companies who help us deliver features or support, data storage, payment processing and email automation services.

We only provide third parties with the information they need to know to perform their specific services. We work closely with all the third parties to ensure that your personal data is secure and protected at all times. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions. Our contracts with third parties make it clear that they must hold information it securely, abide by the principles and provisions of data protection, and only use information as we instruct them to.

In all instances where we disclose your information to third parties, we will ensure that your information is appropriately protected. If we stop using their services, any of your personal information data held by them will either be deleted or rendered anonymous.

Please note that our website, the GoJoe App and the GoJoe Business Manager may contain links to other websites which are outside our control and are not covered by this Privacy Policy. If you access other sites using any of the links provided, please check their privacy policies as the operators of these sites may collect information from you which will be used by them in accordance with their privacy policy, which may differ from ours.

Where your personal information may be processed.

Sometimes we need to share your personal information with third parties and suppliers outside the UK in Europe, noting in particular that GoJoe’s data processing cloud services and associated microservices are hosted (by Amazon Web Services) in Dublin, Ireland among other suppliers including customer.io (push notifications), Mixpanel (data reporting), Intercom (live chat) and Getstream (in-app chat).

If we do this, we have procedures in place to ensure your data receives the same protection as if it were being processed inside the UK. For example, our contracts with third parties stipulate the standards they must follow at all times. If you wish for more information about these contracts, please contact info@gojoe.com.

Any transfer of your personal information will follow applicable laws and we will follow the guiding principles of this Privacy Notice.

Cookies

A cookie is a piece of data stored locally on your computer containing information about your activities on the Internet. Each website can send its own cookie to your web browser if your browser's preferences allow it. Many websites do this whenever a user visits their website in order to track online traffic flows.

GoJoe does not use Cookies or similar personal tracking within the GoJoe App. We do adopt Facebook and Google analytics for insights, however the cookies do not collect information which would directly identify anyone and does not collect personal or special category data.

The GoJoe App authentication process uses JSON Web Tokens (https://jwt.io/ ) as part of the app functionality and is necessary to provide you with access to the GoJoe App.

We may share anonymised user data (which for the avoidance of doubt does not include any personal information) with advertising networks and/or social media platforms for the purposes of selecting and serving relevant adverts to you via those networks/platforms, and to search engine and analytics providers. If you have consented to such communications, we will pass your personal data on to our official partners, who will use such data to communicate offers, discounts and other messaging from time to time.

Data Security:

We work hard to keep your information safe. We use a combination of technical, administrative, and physical controls to maintain the security of your data.  

Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted.

GoJoe operates password-less architecture in a commitment to its best practices with regards account security.  In cases where we do give you (or where you have chosen) a password that enables you to access certain parts of our services, including our GoJoe App or website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Once we have received your information, we will use strict procedures and security features to try to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way.

We will collect and store personal data on your device and/or cloud service providers using secure communication through https as between your device and the cloud service providers and other technology.  Data is stored on a MySQL server.

For GoJoe services including workplace challenges and other community features we include social networking, chat groups and other social features. Please ensure when using these features that you do not submit any personal data that you do not want to be seen, collected or used by other users.  You may toggle your privacy settings from within the profile section of our app which restricts the ability of other users to see certain of your information and posts.

Whilst we work hard to ensure that personal data processed is subject to appropriate security we cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using third party material derived from our GoJoe App, the GoJoe Business Manager or website. As best practice, we also strongly recommend that you regularly run anti-virus programmes on all material downloaded from the Internet.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator when we are legally required to do so.


Your rights

Our GoJoe App gives you access to your account settings and tools which allow you to access and control your personal data.  By logging into your account and using your account settings, you can change and delete your personal information. For instance, you can edit or delete the profile data you provide and delete your account if you wish and change the push notification settings.

The right to be informed.

We aim to be transparent within our privacy policy and provide you with information about how we use your personal data.

Right of access.

You have the right to request a copy of any information that we hold about you. We try to be as open as possible as we can be in terms of giving people access to their personal information. Individuals can find out if we hold any personal information by making a subject access request.

The right to rectification.

You have the right to request the correction of your personal data when it is incorrect, out of date or incomplete. Some corrections can be completed via your account settings. You can also contact us, and we can amend inaccurate personal data, however, please note that in some circumstances we may ask for the documentary proof that the amendment is necessary.

The right to erasure.

You can request the erasure of your personal data when it is no longer necessary, you withdraw consent, or you object to its processing. Some information held by us is required by law to be held for a period of time. You can contact us if you wish to make a request.

The right to restrict data.

You can request that we restrict the processing of your personal data. This can be done in circumstances where we need to verify the accuracy of personal data, if you do not wish to have personal data erased or you object to the processing and we are considering this request.

The right to data portability.

Under some circumstances you can request a copy of the personal data you provided to us in a machine-readable format or ask that this data be transferred another third party.

The right to object.

In some circumstances you can stop the processing of your personal data for reasons connected to your individual situation. We must then do so unless we believe we have a legitimate overriding reason to continue processing your personal data. Where your details are used for marketing, you can opt out at any time. You are able to unsubscribe from marketing on each contact or you can contact us on info@gojoe.com to object to any processing.

Automated decision making and profiling.

You will be notified if we a solely automated decision which produces a legal effect or significantly affects you.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. Please contact us at info@gojoe.com or by using our postal address if you wish to make a request.
